2. Description of Services

Enhanceo provides artificial intelligence image processing and generative visual tools, including photo enhancement, image upscaling, image reworking/restoration, retouching, AI filters / transformations, and black-and-white photo colorization. Features, generation speed, and processing allowances vary between free tiers, trial quotas, and active paid subscription plans.

3. Content Ownership, Rights & Limited License

• Ownership Principle: Enhanceo does not claim ownership of an image merely because it is uploaded to the service. Users retain whatever ownership, copyright, privacy, publicity, or other rights they lawfully hold in their content. Nothing in these Terms grants a user rights in content that they did not already possess or lawfully obtain.
• Processed Output: As between Enhanceo and the user, Enhanceo does not claim ownership of processed output solely because Enhanceo provided the processing service, subject to applicable law and the rights of third parties.
• Limited License: You grant Enhanceo a non-exclusive, worldwide, royalty-free license solely to host, store, copy, transmit, process, transform, and return the image as necessary to operate Enhanceo and fulfill your requested processing.

4. User Responsibilities & Representations

You are solely responsible for the content you choose to submit and for ensuring that your submission and requested processing are lawful. You must possess whatever ownership, permissions, consents, licenses, authorizations, or other legal basis is required to upload and process each image, including any consent required from depicted individuals.

Enhanceo’s automated acceptance, storage, transmission, enhancement, or transformation of content does not constitute approval, endorsement, verification of ownership, or authorization of that content.

5. Prohibited Content & Acceptable Use

You agree not to upload, transmit, or process any images or material that:

• Are unlawful, infringing, abusive, defamatory, or harmful.
• Contain sexually explicit content, non-consensual intimate imagery, child exploitation, or severe violence.
• Promote hatred, harassment, self-harm, or unlawful discrimination.
• Attempt to probe, bypass, disrupt, overload, or reverse-engineer Enhanceo servers, rate limits, or accounting balances.

Violation of these terms may result in immediate suspension or permanent termination of your account without notice or refund.

6. Third-Party AI Inference & Output Disclaimers

• Generative AI Models: Enhanceo utilizes third-party artificial intelligence inference APIs, including OpenAI and Google Gemini, to perform photo enhancement, visual transformations, and restorations.
• Inherent Variability: Generative AI outputs are probabilistic and may vary in detail, realism, and style. Enhanceo does not guarantee specific artistic outcomes, complete error-free generation, or absolute photographic perfection.
• Limitation of AI Liability: To the maximum extent permitted by applicable law, Enhanceo is not liable for losses arising solely from malicious third-party activity or circumstances outside its reasonable control where Enhanceo has fulfilled its applicable legal obligations.

7. Subscriptions, Store Policies & Cancellation

• Store Billing: Paid subscriptions (weekly, monthly) and credit packs are processed and billed directly through the Apple App Store or Google Play Store via RevenueCat. All transactions and refunds are governed strictly by the respective store’s terms.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours prior to renewal through your Google Play or Apple ID account settings.
• Active Subscriptions Notice: Deleting your Enhanceo account does not automatically cancel subscriptions billed through the App Store or Google Play. Cancel your subscription through the applicable store to prevent future renewals.

8. Disclaimers, Security & Limitation of Liability

• “As Is” Basis: Enhanceo is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory.
• Security Notice: Enhanceo uses HTTPS/TLS to protect information transmitted between the application and our production services and when communicating with supported third-party APIs. No internet-connected system, server, API, or storage environment can be guaranteed to be completely secure.
• Liability Cap: To the maximum extent permitted by applicable law, Enhanceo and Adorasoft are not liable for losses arising solely from malicious third-party activity or circumstances outside their reasonable control where Enhanceo has fulfilled its applicable legal obligations. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
